We reserve the right to modify, suspend, or discontinue all or part of the Services at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Services.
7. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The Services will be uninterrupted, secure, or error-free;
- Any defects will be corrected;
- The Services are free of viruses or other harmful components.
You use the Services at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Truck Genie and its affiliates, officers, employees, agents, and licensors shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages;
- Any loss of profits, data, or goodwill;
- Any damages exceeding the amount you paid (if any) for the Services in the past twelve (12) months.
Some jurisdictions do not allow limitations of liability, so some of these limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Truck Genie, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:
- Your use of the Services;

10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of West Virginia without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved exclusively in the state or federal courts located in Marion County, West Virginia, and you consent to the personal jurisdiction of those courts.
11. Changes to the Terms
We may modify these Terms from time to time. When we do, we will provide notice (e.g., posting the updated Terms in the App). Your continued use of the Services after any update constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Services.

13. Assignment and Change of Control
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
